    What Is Sexual Harassment

    Under federal law, the EEOC's definition of sexual harassment is "unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature that has the purpose or effect of unreasonably interfering with an individual's work performance or creating an intimidating, hostile, or offensive working environment."  Under California law the definition is the same.

    What Does Hostile Work Environment Mean

    Hostile work environment sexual harassment occurs when an employee is subjected to unwelcome sexual advances or subjected to the use of sexual language that is sufficiently severe or pervasive that it would offend a reasonable person. This type of sexual harassment must be sufficiently severe or pervasive that it alters the conditions of the offended employee's employment and creates an abusive environment.

    A single instance of sexual harassment in the "hostile work environment" may be sufficient to constitute actionable sexual harassment but this is rare. Touching of sexual body parts is the most common example of a single instance that may constitute sexual harassment, so long as the touching was unwelcome. Repeated instances of a supervisor or co-worker touching your sexual body parts or repeated instances of verbal sexual harassment against you increase the chances that you have a good sexual harassment case.

    Bear in mind that it is possible for you to make a sexual harassment hostile work environment claim even when the harassment is not directed at you, so long as you were offended by it. Thus, you can make a hostile work environment claim if you witnessed the harassing conduct and the conduct was severe or pervasive. In regard to unwanted sexual advances, an employee must generally show that she gave notice that the advances were unwelcome, by reporting it to a supervisor or HR, or both. Also bear in mind that although favoritism by a supervisor towards an employee with whom the supervisor is having a consensual sexual affair does not constitute harassment of other employees, but a pattern of sexual favoritism may constitute a hostile work environment in the event that the message by management is that sexual affairs are a way to get ahead in the workplace.
