Don’t Make These Mistakes:

  • Not telling the harasser to stop: In order for you to have a case, you must prove that the harassment was “unwelcome.” Therefore, tell the harasser to stop harassing you and an email is the best way to do it. Save a printed copy of the email at your home because you will need it later on as proof that you told the harasser to stop. Don’t show the email to anyone except your attorney.
  • Not seeing a doctor or mental health care provider early: As soon as you have been victimized by sexual harassment and feel emotionally distressed by it, immediately see your doctor and report it to her/him or see a mental health care provider and report it to that person, and get the help you need. This also helps with documenting the harassment, which will help to prove your sexual harassment case.
  • Not reporting to HR that you were sexually harassed: Again, an email is one of the best ways to report it. A verbal complaint will suffice, but do yourself a big favor and put everything in writing and print it out and save it at home. Do not speak with HR or their investigator about the harassment. Email them and tell them to put all questions they have for you in an email to you and save a copy of that writing and have your attorney help you answer the questions.
  • Not documenting the sexual harassment: Keep a journal or diary of what happened but don’t tell anyone you have it, especially anyone at the company. Only tell your lawyer about it and only show it to your lawyer, no one else.
  • Not knowing your rights.
